Extraordinary Ability Aliens

Seeking permanent residence under employment based first preference category as an Extraordinary Ability Alien requires a demonstration of "sustained national or international acclaim and recognition of achievements in the field" by providing: A) evidence of a one-time achievement of a major internationally recognized award like the Nobel Prize; or B) comparable evidence which establish the individual has reached the very top of his or her respective field.

A major advantage to qualifying as an Extraordinary Ability Alien is an exemption from the job offer and labor certification requirements. As such, this classification is one of the rare instances where individuals may self petition. The individual must establish that they will continue to practice or engage in their area of expertise in the United States.
