National Interest Waivers

For the vast majority of individuals seeking employment based permanent residence, a Labor Certification is a necessary prerequisite. However, certain individuals who possess an advanced degree and who are able to document exceptional ability in the arts, business, or sciences may seek a waiver of the job offer and Labor Certification requirements if there is substantial evidence that conferring permanent residence would be in the national interest.

Obtaining a National Interest Waiver has become significantly more difficult in the post-NYSDOT era. Foreign nationals must now establish that they will seek to engage in a field of endeavor that is of substantial intrinsic merit, that the proposed endeavor will be national in scope, and must persuasively demonstrate that the national interest would be adversely affected if a Labor Certification were required.
