Individuals seeking to immigrate to the United States on the basis of a familial relationship may become Lawful Permanent Residents by being sponsored by a qualifying family member who is a citizen or Lawful Permanent Resident of the United States. For individuals already in the United States, Adjustment of Status is the last step in a multi-step process for gaining Permanent Residence in this manner.
Adjustment of Status enables individuals to apply for Permanent Residence without having to travel to a United States embassy or consulate abroad. Generally, individuals seeking Permanent Residence on the basis of a familial relationship must be lawfully present in the United States, possess an approved Immigrant Petition or file one concurrently with the Adjustment, and have no bars to admissibility. In the case of immediate relatives, which include parents, spouses and unmarried children under the age of 21, there is no need to wait for a visa number to become available.
