The North American Free Trade Agreement (NAFTA) created the TN classification to allow United States employers to sponsor Canadian and Mexican citizens for certain designated professional positions for up to one year. The TN classification is the most expeditious of all employment-based nonimmigrant categories. Canadians citizens can have their TN applications adjudicated at most ports of entry at the time they intend to enter the United States to engage in the professional activity. This provides a huge processing advantage over other visa categories that may take weeks or months to complete. In addition, the TN visa category does not have an annual limit and is generally less costly to process. TN status, which was previously granted in one-year increments, is now granted in periods of up to three years, as long as the applicant maintains nonimmigrant intent.
The Bae Law Group helps make the TN process simple and effortless. Our attorneys review positions and candidate credentials for TN eligibility, prepare the necessary documentation for adjudication, and brief the candidate prior to entry, including providing information on different Ports of Entry. We also regularly file TN extensions for clients via the USCIS Vermont Service Center.
