The L visa allows multinational companies to transfer key employees from their foreign offices to the United States. L visas are available for the transfer of employees who have worked for the sponsoring company abroad in an executive, managerial or "specialized knowledge" capacity for at least one year. The foreign employer and United States sponsoring employer must be able to demonstrate common ownership and control.
The L-1A "Executive and Manager" classification provides maximum flexibility for multinational executives and managers. It is not subject to annual visa quotas and has no prevailing wage or worksite location restrictions. L-1A workers may stay in the United States for up to 7 years, and in most cases, persons granted L-1A status are also eligible for a streamlined application process for permanent residence that can cut years off the wait for a green card. In addition, this visa is often used by foreign companies as a means to open new offices in the United States.
The L-1B "Specialized Knowledge" worker classification can be used to transfer to the US key employees who possess unique or uncommon knowledge of the company's products, and/or an advanced level of knowledge of the company's processes and procedures.
